Defiler gets 14 years jail in Lumphi

The Rumphi first grade magistrate court on September 3,  2019 convicted and sentenced a 46 year old deputy head teacher to 14 years  imprisonment with hard labor for defiling a 13 year old girl which contravenes section 138(1) of penal code.

The court head that the convict  committed the offence on 28 June 2019 at Mwale Primary school I the district where the convict called the victim to his house as his school pupil.

“The convict was defiled as she just entered the house of the convict and latter gave the victim k1 000 (one thousand kwacha only) for her not to disclose the ordeal.’’

On July  3 2019 the victim  report the matter to the  child counselor who visited  mwale primary school on sexual abuse  lesion and later on the mater was   reported to the police where they arrested him    

Appearing in court , the  convict pleaded not guilty to the court which prompted  the state to Palade six witnesses to proved the case beyond  reasonable doubt and later on the court convicted him 

In her  submission, state prosecutor sub inspector Rose Mwandelire prayed for stiffer   punishment to teach him a lesson and deter the would be offenders

In mitigation the convict played  for leniency saying he is a bread winner

Passing judgment the  first grade magistrate Cathbert Phiri  concurred with states submissions and   slapped the convict with 14 years jail term.

The convict ,Chipateni Gondwe  hails from Vitendwe village, Traditional Authority Chikulamayembe in Rumphi District .
